  • Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
  • Personal Data is any information that relates to an identified or identifiable individual.
  • Service refers to the HVAKR platform, including the HVAKR website and web application.
  • Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.
  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
  • Website refers to HVAKR, accessible from https://www.hvakr.com
  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.

We may also collect information that Your browser sends whenever You visit our Service or when You access the Service by or through a mobile device.

Use of Your Personal Data

The Company may use Personal Data for the following purposes:

  • To manage Your Account: to manage Your registration as a user of the Service. The Personal Data You provide can give You access to different functionalities of the Service that are available to You as a registered user.
  • For the performance of a contract: the development, compliance and undertaking of the purchase contract for the products, items or services You have purchased or of any other contract with Us through the Service.
  • To contact You: To contact You by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities, products or contracted services, including the security updates, when necessary or reasonable for their implementation.
  • To provide You with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about. Where required by applicable law, We send marketing communications only with Your prior consent, and You can opt out at any time using the unsubscribe link in any such message or by contacting Us.
  • To manage Your requests: To attend and manage Your requests to Us.
  • For business transfers: We may use Your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Us about our Service users is among the assets transferred.
  • For other purposes: We may use Your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Service, products, services, marketing and your experience.

Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

We apply the following retention periods:

  • Account data (name, email, and account record): Retained for as long as Your account is active. When an account is deleted, the account record is removed from Our active systems promptly. Accounts that are never email-verified are automatically deleted within approximately 14 days of sign-up.
  • Project content You create: When You delete a project, it is moved to a recoverable state from which it can be permanently deleted; permanently deleting a project removes its content from Our active systems.
  • Server and application logs: Retained for approximately 30 days.
  • Analytics and product-usage data (including IP address, collected through our analytics provider and, where required, only after You consent): Retained for [TO CONFIRM — analytics provider retention period] and then deleted in accordance with our analytics provider's data-management settings.
  • Backups: Deleted data may persist temporarily in routine encrypted backups, which are rotated and fully expire within 90 days at most.

When You request deletion, We remove Your Personal Data from Our active systems promptly and from Our backups within 90 days, except where We are required to retain certain information to comply with legal obligations, resolve disputes, or enforce our agreements.

Billing and payment records. Payment and invoice information for paid plans is processed and stored by Our payment processor (Stripe) and retained in accordance with Stripe's retention practices and applicable financial-record laws. When an account or organization is deleted, the billing records held in Our own systems are deleted.

Transfer of Your Personal Data

Your information, including Personal Data, is processed at the Company's operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of Your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from Your jurisdiction.

The Company will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy and no transfer of Your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of Your data and other personal information.

Where we transfer Personal Data out of the United Kingdom or the European Economic Area (EEA) — including to the United States, where Flow Circuits, Inc. operates — we rely on appropriate safeguards recognized under UK and EU data protection law, such as the UK International Data Transfer Agreement (IDTA) or Addendum and the European Commission's Standard Contractual Clauses (SCCs), together with supplementary measures where necessary.

Disclosure of Your Personal Data

Business Transactions

If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.

Law enforcement

Under certain circumstances, the Company may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

If you are a resident of California or another U.S. state with a comprehensive privacy law (such as Virginia, Colorado, Connecticut, or Utah), you have the following rights regarding your Personal Data, subject to certain exceptions:

  • Right to know / access — you can request the categories and specific pieces of Personal Data we have collected about you, the sources, the purposes for collecting it, and the categories of third parties with whom we share it.
  • Right to delete — you can request that we delete the Personal Data we have collected from you.
  • Right to correct — you can request that we correct inaccurate Personal Data.
  • Right to opt out of sale or sharing — we do not sell your Personal Data, and we do not share it for cross-context behavioral advertising.
  • Right to limit use of sensitive Personal Data — we do not use or disclose sensitive Personal Data beyond the purposes permitted by law.
  • Right to non-discrimination — we will not discriminate against you for exercising any of these rights.

You may use an authorized agent to submit a request on your behalf. We have not sold Personal Data or shared it for cross-context behavioral advertising in the preceding 12 months.

Our Service Providers and Sub-processors

We rely on a limited set of trusted third-party service providers (sub-processors) to operate and deliver the Service. Each processes Personal Data only on our instructions and is bound by data protection obligations. Our current sub-processors are:

  • Infrastructure and core operations: Google Cloud Platform / Firebase (cloud hosting, database, and authentication); Stripe (payment processing); Twilio SendGrid (transactional and marketing email); PostHog (product analytics and error monitoring); Extend (parsing of documents you upload, such as PDFs and spreadsheets).
  • AI features: Anthropic, OpenAI, Google, and xAI — and, through the OpenRouter gateway, additional model providers — process your project content and instructions to generate results; Cohere provides search reranking. Under our agreements, your data is not used to train these providers' models, and we do not sell your project data.
  • Account management and enterprise services: WorkOS (single sign-on and directory synchronization, where your organization enables it); Tremendous (processing reward or referral payouts, where applicable).
  • Business operations: Notion (record-keeping across organization, project, billing, and support data) and Slack (operational notifications).

An up-to-date list of our sub-processors is available on request, and we maintain data processing agreements with each sub-processor that handles Personal Data on our behalf. Business and enterprise customers' Personal Data is processed under our Data Processing Agreement, which governs our use of sub-processors and provides advance notice of changes.

How We Use Data for AI Features

Some HVAKR features use third-party large language models (including Anthropic, OpenAI, Google, and xAI, and additional providers reached through the OpenRouter gateway) to help you design HVAC systems, generate reports, and interpret project content. When you use these features, the relevant project content and your instructions are sent to these providers solely to generate and return results to you. Under our agreements with these providers, your data is not used to train their models. We do not sell your project data, and we do not use the contents of your engineering projects to train AI models.

Children's Privacy

Our Service does not address anyone under the age of 13 (or, in the United Kingdom and EEA, under the age of 16, or such lower age as applicable national law permits). We do not knowingly collect personally identifiable information from children below the applicable age. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from a child below the applicable age without verification of parental consent, We take steps to remove that information from Our servers.

If We need to rely on consent as a legal basis for processing Your information and Your country requires consent from a parent, We may require Your parent's consent before We collect and use that information.

Our Service may contain links to other websites that are not operated by Us. If You click on a third party link, You will be directed to that third party's site. We strongly advise You to review the Privacy Policy of every site You visit.
